- Filing for divorce in Louisiana is relatively simple compared to some other states. The first step is establishing residency. In order to file for divorce in the state of Louisiana, you must have been a resident of Louisiana for 12 months. The divorce can be filed in either the parish of the filing spouse, or the responding spouse.
- Louisiana offers a no-fault divorce that simplifies the process even further. A no-fault divorce is awarded based on irreconcilable differences, and the wish to divorce, rather than having to establish grounds for the divorce. In order to obtain a no-fault divorce, file a Petition for Divorce in the Superior Court of your parish.
- Once the Petition for Divorce has been filed, and 180 days has passed, the divorce will only be made final under certain conditions. First, the couple must still be living apart. Second, the filing spouse must file a motion called "Rule to Show Cause." This motion requests the final divorce judgment by the court. If there are children, the couple must wait one year, rather than 180 days, for the final judgment to be made.
