How to Get an HOA Ruling Overturned in Georgia

    • 1). Write a letter to the HOA, detailing the problems with the ruling. Cite the relevant HOA bylaws in your letter and explain how the ruling violates the bylaws. Request a special meeting to discuss the ruling.

    • 2). Mail your letter by registered mail with return receipt requested so you will have proof that it was delivered.

    • 3). Convince other property owners to attend the meeting with you. Ask them to their own letters to the board or sign a petition in support of overturning the ruling.

    • 4). Attend the HOA meeting. Bring all paperwork regarding the ruling, including correspondence and relevant sections of the bylaws.

    • 5). File suit against the HOA, if the HOA board refuses to rescind the ruling. Georgia law requires a lot owner as recorded on the property deed file the law suit.
