Can OSHA Regulate a State Laboratory?

    OSH Act

    • The Occupational Safety and Health (OSH) Act sets workplace standards and ensures standards compliance for the safety and health of employees working in the United States. However, this coverage does not extend to federal and state employees.

    Federal Agencies

    • Some federal agencies specifically regulate working conditions in their industries. Therefore, a state lab in the mining, nuclear energy, nuclear weapons or transportation industries may be subject to the health and safety regulations of the agency that has jurisdiction over that industry.

    State OSHA

    • Under the OSH Act, states have the option of adopting a state occupational safety and health program that must be at least as effective as the federal program but can exceed the requirements of the federal program. Some states, listed at the osha.gov website, do have plans that cover state employees.
