- Keep records of every expense you incur because of the accident. This obviously includes repair and medical bills, but also indirect expenses such as auto rentals or bus fare. You should also document any wages you've lost as a result of the accident---including time spent filing accident reports or speaking with the police. A detailed account with a running subtotal will help you demonstrate the extent of your loss. Don't be surprised if your insurance company's adjuster asks for copies of these records.
- Auto insurance companies frequently make offers about repair or replacement based on its used car value as reported by industry guides. If you feel they have underestimated the value of your car, it's up to you to demonstrate it. You can start by using the same resources---such as Kelley Blue Book---to research the value. Also remember to account for any improvements you've made to the vehicle, such as detailing, new paint or a premium stereo. You can also check print and online classified ads to see if the actual market value for your vehicle is higher than the industry estimates.
- Always keep in mind that your insurance company is a vendor you have hired to provide you with a service. They are not in authority over you, and do not get to simply dictate the terms of the settlement. The first number an auto insurance company gives you is lower than they are willing to go---and lower than you should accept. How high you can negotiate the settlement depends on the numerous complex variations of each accident, but you should always approach it as a negotiation.
- Lawyers are a mixed blessing when it comes to negotiating an auto insurance claim. On one hand, they can streamline and speed up the process, and potentially increase the payoff on the claim. On the other hand, they will take some of that increased payoff for themselves. As a general rule, you should involve a lawyer only if you believe that the insurance company is intentionally underpaying on the claim even after you've attempted to negotiate yourself. Otherwise, the increased payment usually won't match your legal fees. Never hire a lawyer by the hour to negotiate your settlement. Instead, use an attorney who will represent you for a percentage of the settlement.
