- A child restraint device must be used in a vehicle for any child who is under the age of eight and weighs less than 80 lbs. Once a child reaches either the age or weight requirements, he can ride in the vehicle without a child restraint device but must wear a properly fitting seat belt. If the child is over 40 lbs., a booster seat may be used.
- The child restraint device must be placed in the rear seat if your child is under the age of five and 40 lbs., the vehicle has a backseat and comes equipped with a passenger air bag. If you are using a child restraint device that is designed for use with air bags, it is allowed to be installed in the front seat.
- Drivers of the vehicle are responsible for all passengers under the age of 16. If you do not follow the North Carolina Child Passenger Safety Law and are issued a citation by a police officer, you could lose two driver license points and may have to pay a small fine of $25 or less as well as court costs of $141.
