Instructions for Filing for Bankruptcy in Arizona

    • 1). Download the petition for bankruptcy, credit counseling certificate, schedules A through J, Statement of Intention, Statement of Affairs and Declaration of Employer Payments from the website for the Arizona Bankruptcy Court or obtain them in person from the court.

    • 2). Obtain pre-bankruptcy credit counseling. You can find approved credit counselors in Arizona on the bankruptcy court's website.

    • 3). Have your employer fill out the statement of employer's payments. You must turn this form in to the court at least 60 days before filing for bankruptcy.

    • 4). Fill out the petition completely, adding information for both yourself and any joint debtors. Indicate that you have received the mandatory credit counseling on the petition by checking the correct box in Exhibit D. You and any joint debtors must sign the petition.

    • 5). Fill out schedules A through H. You only have 45 days to file these forms after filing the petition, so you should file everything at the same time. On the schedules, list all your assets, including community property with your marriage partner. Do not leave anything blank. If you do not have a particular asset, write "0" on the appropriate line. List creditors by name and address on the correct schedules.

    • 6). Report your income on schedule I. You must also report your spouse's income even if your spouse is not a joint debtor. List expenses on Schedule J.

    • 7). Transfer the total from each schedule to the summary of schedules. Fill out the Statement of Financial Affairs, checking it against each schedule to make sure all financial information is consistent.

    • 8). Complete the statement of monthly income and means test calculation forms. Check these forms against Schedules I and J to ensure all information is consistent.

    • 9). Complete the Statement of Intention. Indicate whether you will surrender property or attempt to keep it.

      Make a copy of all forms for your records. Turn in the original to the court and pay the filing fee.
