A trial date has been set in connection with the wrongful death lawsuit filed by the family of a man who was allegedly struck and killed by a Dallas County sheriff's deputy.
The Dallas Morning News, a local newspaper in Dallas Texas, reports that the case against the county has been scheduled for no later than March 1. The news provider reports that the lawsuit, filed on behalf of the parents of Richard Madrigal, contends that Deputy John Ludwigs was negligent when he struck Madrigal with his patrol car while responding to a call in 2008.
Ludwigs was reportedly answering a disturbance call but did not have his emergency lights on as he sped onto the southbound ramp of Interstate 45. Ludwigs reportedly told officials that he saw Madrigal running across the ramp at the time of the collision and that the victim kept going even as he applied the brakes.
The lawsuit is reportedly seeking damages for pain and suffering as well as payment for medical costs and funeral expenses for the family of the deceased.
