Company Tries to Escape Paying $2 Million in Mesothelioma Case

Recently, the company Pneumo Abex LLC tried to get out of paying nearly $2 million dollars in a lawsuit. After losing a case to personal injury lawyers regarding now deceased James A. Lovelace, the company tried to appeal the loss, stating that there wasn't enough evidence against them to prove they were the cause of Lovelace's mesothelioma. Similar cases of mesothelioma have happened all over, in Utah and abroad, but most companies do not attempt to back out of having to pay the settlement.

Thankfully, the courts denied the new trial, stating that the company was the sole reason for his pain and suffering. The court stated that the evidence spoke for itself, seeing as how asbestos is the only cause of mesothelioma. According to the expert Allan Smith, there were excessive amounts of chrysotile the form of asbestos use by Pneumo Abex LLC, found in their brake products. Anyone from Utah or elsewhere could have fallen to mesothelioma much like Lovelace did, but thankfully the company can't shy away from it.

Being exposed to a large quantity of asbestos while working as a plumber and truck mechanic, Lovelace suddenly found himself in need of some personal injury lawyers to help him with his case. Lovelace's son was even exposed second handedly to large amounts of asbestos, putting him at risk as well. Parents from the East Coast to Utah must exercise serious precautions when exposing children to certain chemicals, so as to not overexpose them and cause them any illnesses 

Allan Smith did plenty of research, including studying a recent study of mine workers and their exposure to chrysotile. After extensive research and the results of the miners study, Smith concluded that chrysotile asbestos does, in fact, cause mesothelioma. Personal injury lawyers have used this evidence to win many cases just like Lovelace's. 

Further evidence against Pneumo Abex LLC is that asbestos is the sole cause of mesothelioma. X-rays and medical records show that there is no doubt Lovelace suffered from mesothelioma, which could only be related to asbestos exposure. Lovelace was exposed to asbestos through the brake dust that was blown into the air while he was working. This evidence proves that the only way he could have gotten mesothelioma is through exposure to asbestos from Abex. 

It is this evidence that allowed the court to rule against Pneumo Abex LLC's desire to shy away from having to pay the $2 million to Lovelace. Other cases like this have popped up in Utah and all over, meaning that many personal injury lawyers have fought, won, and gotten settlements for thousands of people suffering from mesothelioma.
